THE ADVOCATE GENERAL The Court made the following: 3 The Court made the following: ORDER:- (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) This Writ Petition for Habeas Corpus has been filed seeking direction to respondent Nos.1 to 4-police officials to produce the corpus by name G.Meena before this Court and then to set her at liberty. 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home attached to the office of learned Advocate General appearing for official respondent Nos.1 to 4. 3. Since we are disposing of this writ petition recording the submissions made by learned Assistant Government Pleader, which are confirmed by the learned counsel for the petitioner, notice to respondent No.5 is dispensed with. 4. The petitioner is an advocate by profession. It is stated that he has been renovating his house which is in Vijayawada and he has engaged the services of the corpus by name G.Meena for the purpose of overseeing the work of renovation of his house. It is alleged that there is a dispute relating to the compound wall with the neighbour of the petitioner and when the construction work of the house of the petitioner is going on, that his neighbour has picked up a quarrel at the work place and at the instance of the neighbour of the petitioner, the police have reached the premises and whisked away the worker of the petitioner by name G.Meena and has illegally detained her in their 4 custody from today morning. Therefore, the petitioner is before this Court by way of filing this Writ Petition seeking the aforesaid relief. 5. Learned Assistant Government Pleader, on instructions, submits that as some altercation took place at the house of the petitioner relating to construction of a compound wall, respondent No.4-Station House Officer, Machavaram Police Station received a call from No.100 relating to the said altercation and immediately police visited the premises and at that time, the corpus by name G.Meena, who is the worker of the petitioner, entered into altercation with the police and police brought her to the police station for enquiry and after the enquiry, the corpus was released and was sent away from the police station at about 12:30 P.M today. 6. Learned counsel for the petitioner submits that the police have obtained some signatures of the said corpus on blank white papers. But the learned Assistant Government Pleader has denied the same and he has stated that when they tried to obtain her signatures on the papers stating that she will not indulge in any altercation at the premises where the work is going on that she refused to sign the same. 7. Learned counsel for the petitioner also now concedes that the corpus was released by the police at about 12:30 P.M. Therefore, from the aforesaid submissions made by learned Assistant Government Pleader and also the learned counsel for the petitioner, it is clear that the corpus is now not in illegal custody or detention of the respondents and she is set at liberty from 5 12:30 P.M onwards today. As she was only taken for the purpose of enquiry and thereafter she was sent away from the police station, nothing survives in this Writ Petition for adjudication. 8. Recording the aforesaid submissions of both the learned Assistant Government Pleader for Home and the learned counsel for the petitioner, the Writ Petition is closed.
