GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 26163 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Will of Mandamus, to declare the action of the 3rd Respondent in not taking any action against the Respondent Nos.4, 5 & 6 in pursuant to the Complaint dt.22.11.2021 given by the petitioner, and in-spite of repeated visits of the petitioner, as being illegal, arbitrary and unjust and consequently direct the respondent Nos.4, 5 & 6 to forthwith act upon the complaint dated 22.11.2021 and take action in accordance with law,.…” 2. Heard Sri K.V.Ratnakar, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the respondent police are not taking any action on the complaint made by the petitioner. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of one Sri Rokkala Vijayakrishna, a case in Cr.No.830 of 2021 under Sections 427, 451, 506, 468 and 465 of IPC of Patamata P.S., Vijayawada City on 05.09.2021 against the petitioner and others. The investigating Officer filed an absconding charge sheet in this case against the petitioner vide C.F.No.10406 of 2022 on the file of the learned IV Additional Chief Metropolitan Magistrate Court, Vijayawada. He would further submit that the petitioner had given a petition through 4 Spandana program on 22.11.2021, but he did not turn up to the police station for enquiry. Therefore, they have not registered any case. 5. Recording the above said submissions, this Writ Petition is disposed of. However, the petitioner is at liberty to approach the police to pursue the complaint. No order as to costs.
