By filing this interlocutory application, the applicants, who are the writ petitioners in WP(C) 24/2024 have made a statement in paragraph-5 of this interlocutory application that the applicants are no longer pressing for relief in Page No.# 22/23 prayer no.1 of the writ petition, whereby prayer was made for declaring Rule-15 of the Arunachal Pradesh Police Service Rules, 1989 ultra vires of Articles 14 and 16 of the Constitution of India or alternatively read down Rule 15 to bring it in sync with Rule 5(1)(c)(iv), as amended in 2023. 3. As there is no specific prayer to delete the prayer no.1 in WP(C) 24(AP)/2024, the learned senior counsel for the applicants has been asked to clarify whether they are pressing the prayer no.1. On the said query, the learned senior counsel for the applicants has submitted that he has instruction to the affect that the petitioners are forgoing the prayer no.1 and not pressing the same. 4. The learned Govt. Advocate has taken a stand in their affidavit that the Rule 15 under part VII of the Arunachal Pradesh Police Service Rules, 1989 is not applicable to promotional posts, which comes under Rule 12 of part-V of the said Rules. 5. The prayer made by the applicants is not opposed by the learned Govt. Advocate as well as the learned counsel for the private respondents. 6. Accordingly, this interlocutory application stands allowed. 7. Resultantly, the prayer no.1 in the connected WP(C) 24(AP)/2024 stands deleted. 8.
