Heard learned counsel representing the petitioner and
learned counsel representing the respondents.

In spite of opportunity given to the respondent, the respondent has not filed any counter affidavit.

The grievance of the petitioner is that an amount of Rs.2,05,112/- (Rupees Two Lac Five Thousand One Hundred Twelve),

has been adjusted / deducted from the Gratuity amount of the petitioner, which he was entitled to receive. It is his contention that without affording any opportunity of hearing, in utter violation of principles of natural justice, the amount has been recovered.

In this case, time was granted to the respondents on 19.04.2024 to file the counter affidavit. Again on 21.06.2024, time was granted to the respondents to file the counter affidavit. In spite of two opportunities, the respondents have not filed the counter affidavit. Thus, the statement made by the petitioner in the writ petition, on oath stands uncontroverted. The respondents could not have deducted any amount from Gratuity, that too without giving any opportunity of hearing. Thus, the respondents are directed to refund the amount so deducted from the Gratuity of the petitioner.

Accordingly, this writ petition stands allowed.
