Mr. M.S. Tyagi, Senior Advocate assisted by Mr. Sunil Chandra, Advocates for the petitioner. Mr. Suyash Pant, Standing Counsel for the State. The petitioner proposes to purchase certain land for which purpose he had sought permission under Section 154(4)(3) of the U.P. Zamindari Abolition and Land Reforms Act, 1950, but the matter was pending with the State Government. Therefore, the petitioner sought directions that the recommendation that was made by the District Magistrate to the State Government may be considered within a time bound manner. On 21.03.2025, the Court wanted to know from learned State Counsel as to how much time the State needs to decide such an application? Today, a statement is given by learned State Counsel that the proposal submitted by the District Magistrate, Nainital, has been remanded back to the District Magistrate, Nainital, by the State Government for further enquiry. And after further enquiry, the matter would again be forwarded to the State Government. The Court takes on record the statement given by learned State Counsel. In view of the statement given by learned State Counsel, nothing survives in this writ petition. It stands disposed of,
accordingly. Learned Senior Counsel appearing for the petitioner would submit that the petitioner may be given liberty to raise the issue in future, as and when the occasion arises. The petitioner can always avail that liberty.
