-BEFORE- HON’BLE MR. JUSTICE MRIDUL KUMAR KALITA 31.01.2025 Heard Mr. E. Menjo, learned counsel for the accused petitioner and Ms. L. Hage, learned Addl. PP for the State of Arunachal Pradesh. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Shri Raling Tallang seeking bail of the accused person, namely, Shri Octu Mangam who has been detained behind the bar since 09.01.2025 in connection with Itanagar P.S. Case No.05/2025 under Sections 61 / 117 (2) /138 /238/ 310(2)/329 (1)/351(2) of BNSS,

2023. 3. The aforesaid Police Station case was registered on the basis of an F.I.R., which was lodged by one Shri Takam Tanio, on 07.01.2025, before the Officer-in-Charge of Itanagar Police Station. It has been alleged in the said F.I.R. that one Shri Lezen Gyadi along with 10 (ten) to 15 (fifteen) other unknown accused persons committed dacoity at the Genesis Timex Store located at Akashdeep Complex. It is also alleged that there was some altercation between the main accused and the owner of the shop and thereafter, a group of unknown miscreants entered the shop and vandalised it and also forcefully took away two DVRs of the CCTV footage and damaged other properties of the shop. 4. The learned counsel for the accused person has submitted that the accused person is not involved in the offence as alleged in the said F.I.R. The learned counsel for the accused person also submits that the accused person was arrested on 09.01.2025 in connection with the aforesaid case on the pretext of verifying of their background and criminal antecedent in respect of the alleged offence and since then, he is languishing behind the bar. 5. On the other hand, Ms. L. Hage, learned Addl.
PP has produced the Case Diary of Itanagar P.S. Case No. 05/2025 and has submitted that the statement of the present accused person has already been recorded under Section 180 of BNSS and the investigation has fairly progressed in this case. 6. I have considered the submissions made by the learned counsel for
Page No.# 3/3 the petitioner as well as by the learned Addl. PP. 7. It also appears from the record that in the meanwhile, this Court had already allowed 6 (six) co-accused to go on bail vide order dated 29.01.2025 passed in BA 8 (AP) 2025 and other connected bail applications. 8. On perusal of the Case Diary, it also appears that the accused person is co-operating in the investigation. Hence, this Court is of the considered view that further custodial detention of the accused person may not be necessary for fair and conclusive investigation in this case. 9. Accordingly, the accused person, namely, Shri Octu Mangam is hereby allowed to go on bail on furnishing a bail bond of Rs.30,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate or whosoever is the in-charge. 10.
