02/26.11.2025 Heard learned counsel for the petitioners appearing through Video Conferencing and learned counsel for the State appearing through Video Conferencing.
2. The petitioners are apprehending their arrest in connection with Hunterganj P.S. Case No.156/2025, registered for the offence under Sections 317(5)/3(5) of the BNS, Section 4/21 of M.M.D.R. Act and Rule 54 of the J.M.M.C. Rules, 2004 pending in the Court of the learned Judicial Magistrate, 1st Class, Chatra.

Learned counsel for the petitioners appearing through Video Conferencing submits that the petitioners are owners of two different tractors and the allegations are made that 100 CFT. sand was loaded on each tractor. She further submits that the petitioners have no criminal antecedents, as disclosed in paragraph 12 of this application.

Learned counsel for the State appearing through Video Conferencing opposed the prayer and submits that illegally the sand was being carried on the said vehicles.

Considering that the petitioners happened to be the owners of two different tractors and they have got no criminal antecedents, as disclosed in paragraph 12 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra in connection with Hunterganj P.S. Case No.156/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
