PUBLIC PROSECUTOR The Court made the following Order : The instant Criminal Revision Case has been preferred against the Judgment passed by the learned IV Additional District and Sessions Judge (FTC), Ongole (for brevity ‘First Appellate Court’) in Criminal Appeal No. 62 of 2005. 2. Learned First Appellate Court has confirmed the order of conviction and sentence dated 06.05.2005 passed by the learned Additional Munsif Magistrate, Kandukur in C.C.No.9 of 1997. The order of conviction and sentence issued by the learned Additional Munsif Magistrate, Kandukur is required to be set out for better appreciation of the matter. “Considering the nature of offence I am not inclined to extend the benefit u/s 360 IPC. Considering the plea and facts and circumstances, the accused A2, A4 to A7 are sentenced to pay a fine of Rs. 1,000/- by each i/d 2 months S.I for the offence u/s 147 IPC and A2 is sentenced to suffer S.I for 3 months for the offence u/s 147 IPC and A2 is sentenced to suffer S.I for 3 months for the offence u/s 332 IPC and A4 to A7 are sentenced to pay a fine of Rs. 2,000/- by each i/d to suffer 3 months S.I for the offence u/s 332 r/2 149 IPC.” 3. The Calendar of the impugned Judgment reflected that Accused Nos. 2, 4, 5, 6 and 7 has paid a fine amount of Rs. 1,000/- each and Accused No. 4, 5, 6 and 7 paid a fine amount of Rs. 2,000/- each on 06.05.2025 . 4. Ms. Anusha Dontireddy, learned counsel appearing on behalf of the Petitioners submits that the Criminal Revision Case has already been dismissed as abated against Accused No.2. 5. Having heard the submissions made, it appears that on 16.09.2014, a co-ordinate bench of this Court has taken note of the submission learned counsel for the Petitioners and passed an order in respect of Petitioner No.1/ Accused No.2. 6. Now the scenario of this matter represents that the instant Criminal Revision Case has already abated against the Petitioner No.1/ Accused No.2. In so far as remaining Petitioners/ Accused, they have already complied with the order of sentence and paid fine amount. 7. Accordingly, the Criminal Revision Case has become infructuous and the same is thus disposed of.
