[2025:RJ-JP:3100] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1003/2025 Pankaj Nama S/o Late Satyanarayan, Aged About 34 Years, R/o Bhandaheda, Police Station Kaithun, District Kota Rural (Raj.) (Presently He Is Confined In Central Jail District Kota). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Gajveer Singh Rajawat For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 22/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 06/2025 registered at Police Station Udyog Nagar, District Kota City for the offence(s) under Sections 8/20, 8/29 and 8/25 of NDPS Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. Learned counsel further submits that quantity of contraband articles recovered from the possession of other co-accused Hukam Chand is below commercial quantity who has already been enlarged on bail by the trial court itself, the bail application of accused petitioner was dismissed by the court below solely on the ground that petitioner was found to be involved in similar nature of two cases. It is further contended that from petitioner's possession the recovery of contraband articles i.e. Ganja were not effected though, the petitioner was found in a car with the main accused. The accused- [2025:RJ-JP:3100] (2 of 2) [CRLMB-1003/2025] petitioner is in custody since 04.01.2025 and the investigation/trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application and contended that accused-petitioner is a habitual offender and against him two cases of similar nature were registered therefore, bail application of the accused-petitioner deserves to be dismissed. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the facts that recovered quantity of contraband articles i.e. Ganja are below commercial quantity and accused-petitioner is in custody since 04.01.2025, further investigation/trial of the case will take considerable time, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Pankaj Nama S/o Late Satyanarayan, in connection with FIR No. 06/2025 registered at Police Station Udyog Nagar, District Kota City shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
