Extension of 12 feet road through the petitioner’s private parking in an extent of 40 Sq.Yards in Sy.No.790/4E situated in Nallamadu, H/o Gollagudem village, Unguturu Mandal, Eluru district is the grievance of the petitioner in the present writ petition.
2. Heard Smt Nimmagadda Revathi, learned counsel for the petitioner and learned Standing counsel for Gram Panchayat.
3. Learned counsel for the petitioner in elaboration to what has been stated in the affidavit contended that the 5th respondent Gram Panchayat is trying to extend the 12 feet road through the petitioner’s private parking without following due process of law. As such prayed to pass appropriate orders protecting the interest of the petitioner.
4. On the other hand, learned Standing counsel on counter submitted that the Gram Panchayat has never interfered with the subject land nor passed any resolution to the said effect as alleged by the petitioner. As such there remains nothing for adjudication and accordingly prayed to close the writ petition.
5. A perusal of the counter filed by the 5th respondent-Gram Panchayat would indicate that the Gram Panchayat never ever interfered with the subject land nor passed any resolution nor tried to dispossess the petitioner.
4. In view of the above, as there is no interference from the Gram Panchayat as alleged by the petitioner, this writ petition can be closed.
Accordingly, the Writ Petition is closed. No costs.
Miscellaneous applications, pending if any, shall stand closed.
