Respondent/Respondent/Respondent Petition under Section 439(1 )(b) of Cr.P.C and Section 483(1 )(b) of BNSS, praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to modify the order dt. 26.08.2025 passed by the Judge, Family Court-cum IX Additional District judge, FAC, I Additional District & Sessions Judge -Special Judge for Trial of Offences Under NDPS Act; Rajahmundry in CrI.M.P.No. 854 of 2025 in Cr.No.321/2024 of Jaggampeta police station by considering the situation of the Petitioner/Accused No. 3 as "Petitioner/Accused No. 3 to be released on bail on execution of personal bond for Rs. 10,000/- (Rupees Ten thousand only) with one surety for like sum each to the satisfaction of Judicial Magistrate of First Class, Peddapuram" instead of "Petitioner/Accused No. 3 to execute a personal bond for Rs.20,000/- with two sureties for like each to the satisfaction of the Court of Judicial Magistrate of First Class, Peddapuram" and permit the Petitioner/Accused No. 3 to deposit the surety bond amount of Rs. 10,000/- with single surety instead of Rs.20,000/- with two sureties. I • sum The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of M/s. KOPPISETTI PARVATI DEVI, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following: 2 3. The learned Judge, Family Court-cum-IX Additional District Judge, FAC/- Special Judge for Trial of Offences under Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’)-cum- I Additional Sessions Judge, Rajamahendravaram, on 26.08.2025 in Crl.M.P.No.854 of 2025 in Crime No.321 of 2024 of Jaggampeta Police Station, while enlarging the petitioner/accused No.3 on bail, imposed condition of execution of personal bond for Rs.20,000/- with two sureties for like each to the satisfaction of the Court of Judicial Magistrate of First Class, Peddapuram and with other conditions. sum 4. sum 4. Learned counsel for the petitioner submits that the petitioner is unable to meet the above condition because of his financial constraints. 5. In view of the above reason, the order dated 26.08.2025 mentioned above is modified to the extent of “execution of bond for Rs. 10,000/- (Rupees ten thousand only) with two sureties for like sum each to the satisfaction of the Court of Judicial Magistrate of First Class, Peddapuram”. The rest of the conditions imposed by the learned Trial Court shall be complied with by the petitioner/Accused No.3. 6. Accordingly, the Criminal Petition is allowed.
