HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 17/10/2025 The present bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity “the BNSS”). The petitioners have been arrested in connection with FIR No.0306/2025 registered at Police Station Sadar Dholpur, District Dholpur for the offence(s) under Section(s) 190, 191(3), 121(2), 132, 109(1) & 285 of the Bharatiya Nyaya Sanhita, 2023 (for short “the BNS”) and under Section 3 of the Prevention of Damage to Public Property Act, 1984 (hereinafter referred to as “the Act of
[2025:RJ-JP:42593] (2 of 3) [CRLMB-12863/2025] 1984”) and later on for the offences under Sections 190, 191(2), 121(2), 132, 109(1) & 285 of the BNS and under Section 3 of the Act of 1984. It is contended by learned counsel for the petitioners that they have falsely been implicated in this case wherein, none has received grievous injury and no offence under Section 109 of the BNS is made out. He further submitted that the petitioners are in custody since 18.09.2025, investigation as against them is complete, trial of the case will take time, they have no criminal antecedents except the petitioner No.2 who has one criminal antecedent of trivial nature and similarly situated co-accused persons have already been extended benefit of bail by this Court. He, therefore, prayed for release of the petitioners on bail. Although, learned Public Prosecutor opposed the prayer but, could not dispute that similarly situated co-accused persons have already been extended benefit of bail by this Court. Heard. Considered.
Taking into consideration the contentions advanced by learned counsels for the respective parties, the material available in the case diary, the injury reports which do not reflect grievous injury to any of the injured, their length of custody, absence of criminal antecedents barring the petitioner No.2 who has one antecedent of trivial nature and release of similarly situated co- accused persons on bail by this Court; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioners on bail. [2025:RJ-JP:42593] (3 of 3) [CRLMB-12863/2025] Accordingly, the bail application is allowed and it is directed that accused-petitioners 1. Raju S/o Shiv Singh, 2.Ramveer S/o Megh Singh, 3. Suresh S/o Shiv Singh, 4. Deshraj S/o Singaram, 5. Shri Bhagwan S/o Ramveer, 6. Krishna Kumar S/o Ramveer & 7. Rinkesh S/o Ramtaar shall be released on bail under Section 483 BNSS in connection with afore-mentioned FIR registered at concerned Police Station, provided they furnish a personal bond in the sum of ₹1,00,000/- (Rupees One Lac only) together with two sureties in the sum of ₹50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial court with the stipulation that they shall comply with all the conditions laid down under Section 480(3) BNSS. The Office is directed to remit a copy of this order to the jurisdictional Court through Email forthwith. (MAHENDAR KUMAR GOYAL),J Manish/154
