The Court made the following order:
This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971 against the respondent for willful disobedience of the order dated 05.11.2024 passed by this Court in Writ Petition No.9578 of 2022.
2. Heard Sri Shaik Basha, learned counsel for the petitioner and SmtA.Jayanthi, learned counsel for the respondent.

Learned counsel for the petitioner, in elaboration to what has been stated in the affidavit, contended that this Court vide order dated 05.11.2024
directed the respondent to pass a reasoned order on thepetitioner’s representation dated 19.02.2022 by issuing proper notice to all the parties concerned including respondent No.4 and communicate the same to the parties in accordance with law as expeditiously as possible, not later than three (3) months from the date of receipt of a copy of this order. He further contended that despite the orders of this Court,no notice has been issued to the petitioner, instead, respondent No. 3 has sent an endorsement in R.O.C. A1/60/2022 dated 05.02.2025, merely reiterating the facts stated in his counter affidavit filed in the Writ Petition. Such conduct, according to the petitioner, amounts to willful and deliberate disobedience of the orders of this Court. Hence, the respondent is liable to be punished under Sections 10 to 12 of the Contempt of Courts Act. 3

In reply, learned counsel for respondent, while reiterating the contents of the counter affidavit of the Tahsildar, contended that pursuant to the directions of this Court, respondent has issued notices to the petitioner and the unofficial respondent dated 20.01.2025 with a request to attend for enquiry before this respondent on 28.01.2025 at 11:00 A.M with a request to produce original records pertaining to the House site Plot Nos.3 and 4 of survey No.128/2 of Kammanapalle village of Baireddipalle Mandal. On 28.01.2025, both the petitioner and the unofficial respondent were attended for enquiry. During enquiry, it is found that from the date of issuance of House site patta to the wife of the petitioner, he has not constructed house on the allotted site and their family has left the village 30 years ago, hence it construed that the petitioner has violated the conditions of patta. Accordingly an endorsement has been issued to the petitioner vide Roc.A1/60/2022 dated 05.02.2025 and the same was communicated to the petitioner. Thus, there was no willful disobedience in complying the orders of this Court. She further submits that if the petitioner has any grievance regarding the said endorsement, he may approach appropriate forum for redressal of his grievance. Hence, she prayed to dismiss the Contempt Case. 5. To the said submission, learned counsel for the petitioner submits that the endorsement issued by the respondent is not in the true spirit of the orders of this Court, and that the authority has rejected the petitioners’ application without any justifiable reason. 4

Perused the record and considered the submissions made by both the
learned counsel.
7. This Court,vide order dated 05.11.2024, disposed of the Writ Petition No.9578 of 2022. The operative portion of the said order is as follows:
“The respondent No.3-Tahsildar shall pass a reasoned
order on the petitioner’s representation dated 19.02.2022, by issuing proper notice to all the parties concerned including respondent No.4 and communicate the same to the parties in accordance with law as expeditiously as possible not later than three (3) months from the date of receipt of a copy of this
order.”

It is not in dispute that the Tahsildar has issued Endorsement vide Roc A1/60/2022 dated 05.02.2025 intimating that the requestof the petitioner was rejected, since the wife of the petitioner was violated the condition No.2 of the house site patta and that the petitioner is not permanent resident of Erra- Kadrepalle, having left the village 30 years ago.It is the contention of the
learned counsel for the petitioner that the said order has not been passed in true spirit and the authority has rejected the petitioners’ application without any justifiable reason. Since the scope of contempt jurisdiction is summary in nature and contempt proceedings are not intended to resolve factual disputes or determine the rights of parties, this Court, under the Contempt of Courts Act, shall only adjudicate whether there is willful disobedience of any
judgment or order passed by the Court.

9. In view of the above, since the respondent has issued endorsement on the application of the petitioner, this Court is satisfied that the order of this Court has been complied with and there remains nothing for adjudication. Hence, the Contempt Case is liable to be closed.
10. Accordingly, the Contempt Case is closed. However, the petitioner is at liberty to question the Endorsement vide Roc.A1/60/2022 dated 05.02.2025 issued by the respondent before appropriate forum in accordance with law. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any in the Contempt Case, shall stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI 30.10.2025 MP
