The above contempt case was filed complaining of a violation of the interim order dated 01.11.2023 passed in W.P.No.28248 of 2023. 2. Heard learned counsel appearing on both sides. 3. An interim order was passed by this Court in the aforementioned writ petition, which reads as follows:
“As seen from the proceedings dated 23.08.2023, issued by Commissioner of respondent No.2, provisional notice, under Section 452(1) and 461(1) of the Andhra Pradesh Municipal Corporation Act, 1955 (for short „the Act‟) was issued to the petitioner on 17.05.2023 through online UCIMS Portal.
Later another notice under Sections 452(2) and 461(2) of the Act, was issued on 03.06.2023. However, petitioner did not submit any explanation. Eventually proceedings impugned were issued on 23.08.2023. The contention of learned standing counsel is that notice, dated 17.05.2023 was served on the petitioner through online UCIMS portal. This Court, prima facie, is of the opinion that service of notice through online UCIMS Portal is not proper service. In view of the same,
respondents shall not take any coercive steps against the petitioner pursuant to notice, dated 23.08.2023.”
4. In the contempt case, respondent No.3 in the writ petition, was shown as contemnor. Thereafter, the petitioner filed I.A.No.1 of 2024 seeking to implead Sri Ramesh Kumar Suman, the Principal Secretary, Department of Municipal Administration and Urban Development; Smt. D. Haritha, I.A.S attached to Government Secretariat; Smt. Aditi Singh, I.A.S., working as a Joint Collector and Smt. N. Mourya, I.A.S., working as a Municipal Commissioner, Tirupati as respondents 2 to 5. The said application was filed on 25.11.2024. Thereafter, the contempt case was listed on 31.10.2025 and adjourned on several occasions on the request made on behalf of learned counsel for the petitioner. 5. Today, when the matter is taken up, Ms. Hema, learned counsel representing Sri P.B. Reddy, learned counsel for the petitioner prayed to close the contempt case with a liberty to file a fresh contempt case by impleading the proper parties. 6. Since the petitioner failed to array the proper respondents/contemnors, as per the directions issued, in the contempt case in terms of the order 01.11.2023 passed in W.P.No.28248 of 2023, the Contempt Case is dismissed giving liberty to the petitioner to file a fresh contempt case, if the petitioner is still aggrieved by arraying proper contemnors. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
