The Court made the following ORDER: -. `-, ® a-a.a THE HONOURABLE,SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 542 OF 2025 ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A3 to grant anticipatory bail in connection with Crime No.7/2025 of EIuru Ill Town Police Station, EIuru District. 2) A case has been regl'stered against the petitioner and others for the offences punishable under sections 111 (2)(b), 318(4) read with 3(5) B.N.S, See.7(1 ) of the Essential Commodities Act,1955. 3) The case of the prosecution in brief is that on o8.01.2025 at 7.00 Pm, the informant along With his Staff and mediators intercepted a Bajaj Ape Auto, while A2 who is auto driver was illegally transporting PDS rice to Chicken farms, Rice mills for pecuniary gains against Government rules on the behest of A1, A3, A4 and A5. They seized 450 kgs of PDS rice (worth Rs.18,000/-) and handed over the above Ape Auto (Rs.2,92,634/-) with a report to Eluru Ill Town Police station for further action. 4) Heard. Perused the record. 5) A perusal of the material available on record goes to show that basing on the confessional statement of A3, name of the petitioner has been shown as accused I-n the Present Crime. Learned counsel b--ul a -risrf - 2 appearing for the petitioner states that he js an Engineering Graduate and if he is arrested, his future would be at stake. considering the facts and circumstances of the case, this court is inclined to consider the request of the petitioner herein for grant of anticjpatory bail. 6) Accordl-ngly, in the event of his arrest with regard to this crime, petitioner/A3 sha" be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties for the like sum each, to the satisfaction of the arresting poll-ce officI-alS, and also on condition that the petitioner shall make himself available for investigation as and when required and that they sha" not cause any threat, I'nduCement or promise to the prosecution witnesses.
