06/ 22.12.2025: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Gidhour P.S. Case No. 60 of 2025, registered under sections 126(2)/115(2)/109(1)/3(5) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Ist Class, Chatra.

At the outset, learned counsel for the petitioners submits that petitioner nos. 2 to 4 namely, Ishwar Giri, Basant Giri and Shiban Yadav have already been arrested and in view of that he is not pressing the anticipatory bail application of the petitioner nos. 2 to 4.

Accordingly, anticipatory bail application on behalf of petitioner nos. 2 to 4 is dismissed as not pressed.

Now anticipatory bail application is surviving only on behalf of petitioner nos. 1 and 5 to 7.
6. Learned counsel for the petitioners submits that there are general and omnibus allegation against the petitioners. He then submits that

altercation took place due to some land dispute. He then submits that there are case and counter case between the parties and both sides have received injury. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault and injury are there.

Considering that there are general and omnibus allegation against the petitioners and it has been pointed out that altercation took place due to some land dispute. Further there are case and counter case between the parties.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner nos. 1 and 5 to 7. Accordingly, the above named, petitioner nos. 1 and 5 to 7 namely, Aditya Giri @ Aditya Kumar Giri, Subhash Giri @ Subash Giri, Chandradev Yadav and Bisheshwar Giri, are directed to surrender before the learned court within four weeks from today and in the event of their surrender / arrest, the petitioner nos. 1 and 5 to 7 shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Chatra, in connection with Gidhour P.S. Case No. 60 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
