This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.152/2025 registered at Police Station Gangapur City, District Sawai Madhopur for the offences punishable under Sections 109(1), 119(1), 308(2) of B.N.S. and Section 3/25 of Arms Act. 2. It is submitted that petitioner has been falsely implicated in the present FIR, whereas he has not committed any offence whatsoever. Learned counsel for the petitioner indicates that by entering into compromise on 19.09.2025, the complainant himself has given one application before the court below revealing therein that the petitioner was not involved in the incident and his name was wrongly mentioned in the FIR and affidavit was also filed along with the application. It is stated that petitioner is behind the bars since 23.09.2025. Hence, a prayer has been made to grant bail to the petitioner. [2025:RJ-JP:42673] (2 of 2) [CRLMB-13601/2025] 3. Learned Public Prosecutor has vehemently opposed this bail application. 4. Considered the submissions made at Bar. 5. Looking to the fact that the complainant himself has submitted an application before the trial Court revealing therein that petitioner was not involved in the incident and the petitioner is behind the bars since 23.09.2025, this Court, without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, this Bail Application is hereby allowed. The accused-petitioner Tushar S/o Jeetram shall be released on bail in pursuance of FIR No.152/2025 registered at Police Station Gangapur City, District Sawai Madhopur on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:- (i) He shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) He shall not leave the country without prior permission of the Court. (iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court. (ANAND SHARMA),J Jatin /264
