Mother of the detenu – Ramakrishna – CTP 14982 is before this Court seeking for the following reliefs: a) Set aside the Parole rejection endorsement dated 16-10-2025 bearing reference no. vide Annexure-A and BCP/CTP-Sec/13967/2025 consequently b) Pass order/direction by the nature of writ of mandamus to the Respondent No.02 to release the son of the Petitioner i.e. Sri. Ramakrishna bearing CTP NO. 14982on Parole for the period of 90 days. c) Also grant any additional order/direction that this Hon'ble court may deem fit to grant under the facts and circumstances in the interest of justice and Equity. 2. The detenu was convicted for the offences punishable under Section 302 r/w 34 of IPC in SC No.80/2022 by the II Additional District and Sessions Court, Tumkur and on 18.12.2024 sentenced for life imprisonment. The detenu as on 19.03.2025 has been incarcerated for 3 years, 6 months, 7 days. - 3 - HC-KAR NC: 2025:KHC:50011 WP No. 32430 of 2025 The detenu having made an application for parole on the ground of renovation of his residence, the same was rejected on the ground of adverse police report. 3. The adverse police report does not indicate any particular reason for such rejection except referring to the earlier offence committed by the petitioner and the conviction made thereof of the detenu. In that view of the matter, I pass the following: ORDER i) The Writ Petition is allowed. ii) The endorsement dated 16.10.2025 at Annexure-A is quashed. iii) Respondent No.2 is directed to release the detenu – – Ramakrishna – CTP 14982 on parole for a period of 90 days commencing from 10.12.2025, subject to the following conditions. a) The prisoner (CTP 14982) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the - 4 - HC-KAR NC: 2025:KHC:50011 WP No. 32430 of 2025 responsibility of the jurisdictional Police to take him to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iv) The Registry is directed to communicate the order to the Prison Authority for its immediate execution.
