The present contempt petition has been filed alleging willful non compliance of the order dated 03.07.2019 passed by the co-ordinate Bench of this court in WPS No.4878 of 2019 whereby the petitioner was directed to move fresh representation and in turn the authority was directed to decide the same and an intimation in this regard was also directed to be given to the petitioner within four months from the date of receipt of fresh representation. 2. Learned counsel for the petitioner would submit that pursuant to the said order dated 03.07.2019, he moved his representation on 15.07.2019 and thereafter on 16.09.2020 he made reminder Digitally signed by INDRAJEET SAHU Date: 2025.08.28 13:20:06 +0530 2 representation, but till date his representation has not been decided by the authority. Hence this Contempt Petition. 3. I have heard the counsel for the petitioner and perused the material annexed with the petition. 4. The direction given by the co-ordinate Bench in the main petition was to the extent that the petitioner shall move fresh representation along with copy of order passed in WPS No.4878 of 2019 and, in turn, the authority was directed to decide the representation and to intimate about the outcome of said representation to the petitioner within four months from the date of receipt of fresh representation. The petitioner moved his representation on 15.07.2019 and 16.09.2020, however, after five years of filing representation, the present contempt petition has been filed. 5. Section 20 of the Contempt of Courts Act, 1971 provides limitation to file contempt petition within one year from the date of occurring cause of action. Section 20 of the Acts, 1971 reads as under : “20. Limitation for actions for contempt.—No court shall initiate any proceedings of contempt, either on its own motion or otherwise, after the expiry of a period of one year from the date on which the contempt is alleged to have been committed.” 6. Since the order under contempt has been passed on 03.07.2019; the petitioner moved his representation on 15.07.2019 & 16.09.2020 and the present contempt petition has been filed on 20.08.2025 i.e. much delayed from the period of one year, such inordinate delay refrains this court to entertain the present contempt petition. 7.
