The petitioner's claim for ACP has been declined by the impugned order on the footing that he was appointed on a substantive basis as Naib Moharir on 23.03.1985. The impugned order records that the petitioner was appointed on a substantive basis on 23.03.1985 as Naib Moharir. As per the ACP scheme he is entitled to first ACP after completion of 10 years of satisfactory service. The benefits of entitlement to the second ACP and third ACP are admissible to the petitioner after completion of 16 years of service and 26 years of service respectively. Merely, because the petitioner was given the minimum pay scale on orders passed by this Court does not entitle him to overreach the ACP scheme. The writ petition is dismissed.
