THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The Petitioner is before this Court seeking for the following reliefs: a. Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondents to consider and allow the petitioners request for posting at Lucknow on compassionate medical grounds in view of his wife's ongoing IVF treatment. b. The petitioner prays that this Hon'ble Court be pleased to direct the respondents to consider and decide the petitioners representation dated 30.08.2025 Annexure-E for posting at Lucknow on compassionate medical grounds until the period of march 2026 to conclude the IVF treatment/ pregnancy of his wife till child birth, and to restrain the respondents from taking coercive action against the petitioner. 2. A memo dated 11.12.2025 signed by the learned counsel Petitioner has been filed which reads as under: - 3 - HC-KAR NC: 2025:KHC:52735 WP No. 28360 of 2025 “MEMO The Petitioner in the above said case most humbly states that, he will withdraw the above said Petition from this Hon’ble Court as not pressed in the interest of justice. Hence, this memo.” 3. The submission of learned counsel for the Petitioner is that the Petitioner would apply for long leave up to 10.04.2026 without pay, which could be considered by the respondents, the petitioner being aware of the fact that the period of leave availed would have an impact on the probationary period of the petitioner and as such, the probationary period would also stand automatically extended during the period of leave. 4. The application for leave without pay would be considered by the respondents favourably, and the period availed of his leave would be taken into consideration for extension of probation, considering the present matter as a special case in view of the - 4 - HC-KAR NC: 2025:KHC:52735 WP No. 28360 of 2025 medical emergency faced by the wife of the Petitioner due to a sensitive IVF pregnancy. 5.
