CRL.M.A. 1045/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks extension of parole granted to him vidé order dated 09.12.2025 read with order dated 17.12.2025 made in present proceedings. 2. Pursuant to what was recorded in order dated 09.01.2026 in W.P.(CRL) No.75/2026, the petitioner has filed for extension of parole by way of the present application in the present writ petition, which was earlier disposed-of vidé orders dated 09/17.12.2025. For completeness it may also be noted that order dated 09.12.2025 passed in the present writ petition was subsequently corrected by order dated 17.12.2025, to include both FIRs in which the petitioner was implicated, viz., FIR No. 261/2001 registered at P.S.: Seemapuri and FIR No.611/2001 registered at P.S.: Badarpur, thereby enabling the petitioner to be enlarged on parole pursuant to that order. 4. Ms. Vrinda Bhandari, learned counsel appearing for the petitioner submits, that the petitioner was granted parole for 04 weeks principally on the ground that the petitioner’s mother was bed-ridden; and since at that time, the petitioner’s brother had been transferred to Dehradun, there was no one to take care of their mother. 5. As recorded in the previous orders, the petitioner has been in judicial custody since 16.12.2001; and has undergone actual custody of more than 18 years, which period comes to about 22 years counting remission. 6. Ms. Bhandari submits that in the course of his mother’s treatment, which was for bilateral knee replacement, it transpires that the mother also requires angiography on an urgent basis, as is evidenced by prescription dated 30.12.2025 issued by Max Super Speciality Hospital, Shalimar Bagh, Delhi. 7. Ms. Bhandari submits, that the petitioner was enlarged on parole on 19.12.2025; and the parole runs-out on 15.01.2026. 8. Counsel submits that in view of the intervening circumstances, the petitioner is now constrained to pray that his parole be extended by another 04 weeks. 9. Issue notice. Learned ASC (Criminal) appearing for the State on advance copy accepts notice; and points-out, that in view of what the medical records appended to the application show, the petitioner ought to have taken steps for his mother’s treatment as was advised vidé prescription dated 30.12.2025, but has failed to do so. It is also pointed-out, that there is no fixed date or schedule for the mother’s treatment and an open-ended extension of parole should not be granted. 11. The petitioner is present in-person. The court has interacted with him. 12. Upon being queried, the petitioner explains that since the doctors at Max Super Speciality Hospital had advised that upon conducting angiography, the mother may require further consequential procedures; so the petitioner must ensure of his availability for a longer period, to take care of his mother during the course of such procedures. 13. The petitioner has further said, that though his brother is presently back in Delhi, since he is in private employment, he is unable to take time off work; and would not be able to attend to his mother in the manner that would be required if she has to undergo surgery/medical procedures. The petitioner submits that he wishes to attend to his mother’s needs, since he has been in custody for over 18 years and has never been able to do so. 14. The record of the present proceedings shows, that the petitioner has received several certificates of appreciation from the jail authorities; and evidently therefore, his jail conduct for the last several years has been satisfactory. Upon a conspectus of the foregoing circumstances, based on the documents placed on record, and after hearing learned counsel for the parties as well as after interacting with the petitioner, this court is inclined to allow the present application. 16. It is accordingly directed that the parole granted to the petitioner vidé order dated 09.12.2025 as modified by order dated 17.12.2025, shall stand extended by another 04 weeks, on the same conditions as imposed earlier. 17. It is made clear that no further extension of parole would be granted to the petitioner; and the extension of parole by this order will be counted towards the 01st spell of parole in the new conviction year. 18. The application stands disposed-of in the above terms. W.P.(CRL) 3690/2025 19. The petition already stood disposed-of vide order dated 09.12.2025.
