...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ or any other order or direction particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in not conducting the enquiry as per the proceedings vide RC. No. 911/2025/(G) dt. 21.07.2025 issued by the 3rd respondent in respect of the land being an extent of Ac. 5.13 cents in Sy. No. 57-7, Ac. 3.60 in Sy. No. 56-8 and Ac. 4.96 cents in Sy.
No. 57-4 situated at Ganthimarri Revenue Village, Ramagiri Mandal, Sri Satya Sai District is as illegal, arbitrary and violative of article 14 and 21 of the constitution of India and also contrary to the provision A.P Assignment (Prohibition of Alienation) Act, 1977 and consequently direct the 4th respondent conclude the enquiry as per the above said proceedings and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 4th respondent to conduct the enquiry forthwith per the proceedings vide RC. ORDER:
The present writ petition is filed under Article 226 of the Constitution of India for the following relief:
“…to issue an appropriate writ or any other order or direction particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in not conducting the enquiry as per the proceedings vide RC.No.911/2025/(G) dt.21.07.2025 issued by the 3rd respondent in respect of the land being an extent of Ac.5.13 cents in Sy.No.57-7, Ac.3.60 in Sy.No.56-8 and Ac.4.96 cents in Sy.No.57-4 situated at Ganthimarri Revenue Village, Ramagiri Mandal, Sri Satya Sai District is as illegal, arbitrary and violative of article 14 and 21 of the constitution of India and also contrary to the provision A.P Assignment (Prohibition of Alienation) Act, 1977 and consequently direct the 4th respondent conclude the enquiry as per the above said proceedings and pass…” (in verbatim)
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioner submitted that the petitioner is the absolute owner of the subject property. It is contended that, behind the back of the petitioner, the respondent authorities granted pattas in favour of respondent Nos.5 to 8. Aggrieved thereby, the petitioner submitted a representation dated 21.07.2025 before the Revenue Divisional Officer; however, the same has not been considered. Hence, the present writ petition is filed.

4. Considering the submissions made, and without going into the merits of the case, as the petitioner has a grievance against the grant of pattas in favour of respondent Nos.5 to 8, the appropriate remedy available to the petitioner is to file an appeal under Section 9 of the Act.
5. Accordingly, the writ petition is disposed of, granting liberty to the petitioner to file an appeal in accordance with law. If any such appeal is filed, the competent authority shall consider the same, after issuing notice to all concerned parties, and pass appropriate orders within a period of six (06) months from the date of filing of the appeal. There shall be no order as to costs.
6. This Court is not inclined to go into merits of the case, notice to respondent Nos.5 to 8 is dispensed with.
