...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ or order or a direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondents in not releasing the admitted LS-1 Final bill Gross amount of Rs. 19,04,229/- (Net amount of Rs. 17,25,636/-), even after finalized the bill payable to the petitioner after successful execution of work for Laying of CC Road from D.No.13-11- 603 to ARNN Residency in Tata Nagar and Laying of UGD pipeline from D.No.13-6-600/21/A to 13-6-600/33 in PK Layout Ward No.11/1 (GadapagadapaProgramme) vide its Agreement No.272/E.E/2023- 2024 dated 30-09-2023 in Municipal Corporation, Tirupati, which is illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and also violative of principles of natural justice,consequently direct the respondentsto release the bill amount of Rs. 19,04,229/- due to the petitioner in respect of execution of work forthwith interest of 18PERCENT and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased For the reasons stated in the accompanying affidavit filed in support of writ petition, the petitioner herein praysthat this Honble Court bill amount of Rs.

Order:
Learned counsel for the petitioner submits that the petitioner was awarded the work of Construction of CC Drains and Culverts from D.No. 13-7-906/B to Balaji Hospital in Korlagunta Road and Construction of UDS Manholes in Ward No.10/3 (Gadapagadapa Programme) vide an Agreement No.317/ME/2022-23, dated 31.03.2023 and submitted final bills. A Statement detailing the work executed by the petitioner was prepared, and the progress of the work was recorded in the M-Book. It is submitted that, in all, an amount of Rs.19,98,766/- (Net amount of Rs.18,02,458/-) is due and payable by the respondents to the petitioner. It is submitted that the bills were also uploaded in the CFMS Portal. However, in spite of the completion of all procedural formalities, the payment towards the completed work has not been released till date.
2. Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Municipal Administration and Urban Development; the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the Corporation.
3. During the course of hearing, the learned Standing Counsel appearing for the Corporation does not dispute the submissions made by the petitioner with respect to the completion of work undertaken.
4. Considering the submissions, the respondents are hereby directed to verify and release the payments due payable to the petitioner as expeditiously

as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order.
5. Accordingly, the Writ Petition is disposed off. No costs.
6. Pending miscellaneous petitions, if any, shall stand closed.
