PUBLIC PROSECUTOR The Court made the following: 2 ORDER The instant Criminal Petition, u/s.482 of the Code of Criminal Procedure, 1973 has been filed by the Petitioner/Accused No.5, seeking to grant anticipatory bail in Crime No.410 of 2024 on the file of the S.H.O., Rajanagaram Police Station, East Godavari District. 2. Heard Sri K.P.S.Sailesh Kumar, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor. 3. Learned counsel for the petitioner would submit that the case against the petitioner was lodged solely based on the confessional statement of a co-accused. The petitioner filed a petition before the Special Sessions Judge for the Trial of Cases under the Narcotic Drugs and Psychotropic Substances Act, 1985-cum-I Additional Sessions Judge, East Godavari District, Rajamahendravaram, seeking anticipatory bail, which was dismissed. Learned counsel would further submit that the Court may pass appropriate orders granting liberty to the petitioner to surrender before the Special Court and move an application for regular bail. 4. Learned Assistant Public Prosecutor would submit that there has been no change in circumstances since the dismissal of the earlier application, and the Court may pass appropriate orders as requested by the learned counsel for the petitioner. 5. Considering the submissions made, this Criminal Petition is dismissed, since this Court does not find any merits to consider the case of the petitioner for granting anticipatory bail. However, the petitioner is at 3 liberty to surrender before the Special Court and move an application for regular bail. Learned Special Judge is requested to dispose of the said application as expeditiously as possible according to law.
