The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/ Accused No.7 on bail in Crime No.16 of 2025 of Kandaleru Police Station, SPSR Nellore District, was registered against the Petitioner/ Accused No.7 herein for the offences punishable under Sections 103(2), 140(1), 61(2), 238 and 49 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’).

2. Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor.
3. This Court, in Crl.P. No.10990 of 2025, enlarged Accused No. 6 on bail as the only allegation against him was that he drove the vehicle in which the deceased was transported from Nellore to Rapur. This Court, in Crl.P. No. 10475 of 2025, dated 16.10.2025, enlarged Accused No. 3 on bail on the ground that he had participated in the rekki conducted prior to the killing of the deceased. After thorough investigation, the charge sheet has been filed, and the case is still at the P.R.C. stage. The accusation against the petitioner is well-founded, and the allegations are of a serious nature. Therefore, the principle of parity cannot be extended in favour of the petitioner. Consequently, this Court is not inclined to enlarge the petitioner on bail. Hence, the Criminal Petition is dismissed.
