The Sub-Divisional Officer (P.W.D.) Sub Division - Manendragarh, District - Manendragarh-Chirmiri-Bharatpur (C.G.) 5. The Tehsildar Tehsil- Baikunthpur, District Koriya, (C.G.) ... Respondent(s) For Petitioner : Mr. Tushar Dhar Diwan, Advocate For Respondent No. 1 : Mr. Sudhanshu Upadhyay, Advocate holding the brief of Mr. Sangeet Kumar Kushwana, Advocate For State : Mr. Raj Kumar Gupta, Addl. Advocate General Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 01. 09.2025 1. By way of this review petition, the review petitioner has sought recall/review of the order dated 08.10.2024, passed in WPC No. 4898 of 2024. 2. Learned counsel for the petitioner would argue that a supplementary award was passed by the Land Acquisition Officer vide order dated 20.09.2024, wherein multiplier factor of 2 has been applied, whereas in the writ petition, SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.09.02 14:44:04 +0530 2 it was argued that multiplier of 1 instead of 2 was applied by the Land Acquisition Officer while passing award, therefore, this Court while disposing of the writ petition granted liberty in favor of the petitioner to make a representation before respondent No. 2 i.e. Sub-Divisional Officer(Revenue), Tahsil Baikunthpur, District Koriya and a direction was issued to decide said application within 45 days. It is further contended that the learned Land Acquisition Officer applied multiplier of 2 and passed supplementary award dated 20.09.2024 and this fact was not brought into the notice of this Court. 3. On the other hand, learned counsel appearing for respondent No. 1 would oppose. He would submit that he was not instructed by the litigant with regard to supplementary award dated 20.09.2024 passed by the Land Acquisition Officer. 4. Mr. Raj Kumar Gupta, Addl. Advocate General would support the contention made by Mr. Diwan. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. Considering the fact that supplementary award applying multiplier factor of 2 was passed by the Land Acquisition Officer on 20.09.2024 and this fact was not brought into the notice of this Court; therefore, the order passed in WPC No. 4898 of 2024 is hereby recalled. The WPC No. 4898 of 2024 shall be restored to its original number. 7. The instant review petition is hereby allowed. Sd/- (Rakesh Mohan Pandey) Judge $iddhant
