THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is the brother of the detenue – Ramanjini, CTP No.12449. He is before this Court seeking for the following reliefs: "a. Direct the Respondent No.1 to 4 to consider petitioner’s convict Brother RAMANJANI CTP-13766 application to release him prematurely and grant of general parole for a period of 90 days with - 3 - HC-KAR NC: 2025:KHC:49898 WP No. 12924 of 2025 further extension in accordance with law till the committee considers his premature release. b. Pass any other order(s) which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice." 2. The petitioner having made an application for premature release, the Advisory Board has approved the same and the matter is pending before the Life Convicts Release Committee. 3. In that view of the matter, I am of the opinion that premature release having been approved by the Advisory Board, parole for a limited period could be granted pending consideration before the Life Convicts Release Committee and as such, I pass the following: ORDER (i) The writ petition is allowed. (ii) Respondent No.4 - the Chief Superintendent, Central Prison, Ballari, is directed to release Ramanjini (CTP No.13766) on parole for a period of 90 days commencing from 08.12.2025, subject to the following conditions: - 4 - HC-KAR NC: 2025:KHC:49898 WP No. 12924 of 2025 a) The prisoner (CTP No.13766) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take him to gaol, in the event, the convict (CTP No.13766) would evade going back to the gaol, after the expiry of the period of general parole. b) Respondent No.4 shall stipulate strict conditions as are usually stipulated to ensure return of the detenue to the gaol and that he shall not commit any other offence during then period of parole. (iii) The Registry is directed to communicate the order to the prison authority for its immediate execution. (iv) Learned Additional Government Advocate is directed to place on record the frequency of meetings of the Advisory Board and the Life Convicts Release Committee and the time taken to implement the decision of the LCRC.
