This is Second Appeal filed by the appellants against the impugned judgment and decree dated 12.09.2018 passed by the District & Sessions Judge Mahasamund in Civil Appeal No.H-8A/2023 whereby the First Appeal filed by the plaintiff was allowed and she was declared title holder of 1/9th share of total jointly family property and entitled to get separate possession of her share. The said judgment and decree is under challenge in the present Second Appeal by the defendants. 2. The parties are present before the court. They have submitted that during pendency of appeal they have entered into compromise and executed a deed of settlement on 06.05.2025 and according to their settlement the parties got their respective share over total 11.34 Hect. of land. (7) भूपेन्द्र ो प्राप्त भूकिम खसरा नं. 33 ा दु. ु ल रबा 1.21 हे. ो आपसी सहमडित से फद@ बंटवारा तैयार रवाया है, जिजस पर सभी ी सहमडित है। जिजसी प्रडितत्तिलकिप आवेदन े सा7 संलग्न है। 6. यह कि अन्य तीन बहनें ौशिशल्या चन्द्रार, तेजुबाई चन्द्रार एव स्व. मीनाबाई े वारिरसान मोकिना चन्द्रार, राे श चन्द्रार अपने भाई एवं मामागण े पक्ष में अपना ह त्याग रतें है एवं तीन बहनें या उने वारिरसान भकिवष्य में किसी भी प्रार ी आपत्ति1 या किसी भी प्रार ा दावा संबंडिधत भूकिम पर नहीं रेंगें। 7. यह कि, वाद े दौरान पक्षार क्र. 02 जीवन लाल ी मृत्यु हो चुी है, उने स्7ान पर उने वारिरसान पत्नी-मोतीम बाई चन्द्रार एवं पुत्र-संदीप एवं नीलेश चद्रार ारा उपरोक्त राजीनामा एवं फद@ बंटवारा में अपनी सहमडित प्रदान किये है। जिजस उन्हें ोई आपत्ति1 नहीं है। मृत्यु प्रमाण-पत्र ी प्रडितत्तिलकिप आवेदन े सा7 संलग्न है। 4 8. यह कि उपरोक्तानुसार राजीनामा े आधार पर पक्षारगण अपना अपना नाम राजस्व रिरा;@ में राजीनामा एवं फद@ बंटबारा े आधार पर दज@ रा सते है जिजसमें किसी पक्ष ो ोई आपत्ति1 नहीं होगी। 9. यह कि यह राजीनामा उपर वर्णिणत शतQ े तहत् सभी पक्षारों ी स्वतंत्र सहमडित से किनष्पाकिदत किया गया है एवं माननीय उच्च न्यायालय में लंकिबत अन्य प्ररण कितीय अपील मां 665/2018, 582/2018, 581/2018 ा किनरारण भी इस राजीनामा े आधार पर किया जार लंकिबत सभी प्ररणों पक्षारगण समाप्त रायेंगें।" 3. The parties are present today and they have also verified the terms and conditions of their settlement arrived at between them and now the present appellants does not want to prosecute their appeal any further in view of settlement between the parties. 4. We have also verified the terms and conditions and permitted the appellants to compromise in the matter.
