GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a Writ of Mandamus declaring the action of the 3rd and 4th respondents in calling the petitioners to the police station for the execution of sale deed in favour of 6th respondent through 5th respondent in respect of the property land in survey No. 443-A2 an extent of Acre 0.31 cents and 443-2B an extent of Acre 0.74 cents total admeasuring land Acre 1.05 cents is situated at within limits of Madakasira Municipality, Madakasira, Satya Sai District in the police station is illegal, arbitrary and unconstitutional being violative of principles of natural justice and consequently to direct the 3rd and 4th respondents not to interfere in civil disputes in respect of the property land in survey No.443-A2 an extent of Acre 0.31 cents and 443-2B an extent of Acre 0.74 cents total admeasuring land Acre 1.05 cents is situated at within limits of Madakasira Municipality, Madakasira, Satya Sai District in the interest of justice.” 2. Sri K.Srinivas, learned counsel for the Petitioners would submit that it is a case of interference of Police in the civil disputes between the parties. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by Respondent No.5, a case in Crime No.221 of 2024 on the file of Madakasira Police Station, Sri Sathya Sai District for the offence under Section 85 of BNS has been registered against the Petitioners herein and others. It is further submitted that the Police never insisted the Petitioners to execute any sale deed in favour of Respondent No.5 in the matrimonial disputes. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere with the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
