Shri Vinay Kumar Pandey, learned counsel for the applicant, Shri Abhishek Yadav, learned counsel for the opposite party no. 2 and 3 and Shri Manvendra Pratap, learned AGA for the State are present. 2. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 05.03.2025 passed in Case No. 2423 of 2024, under section 144 of Bhartiya Nagarik Suraksha Sanhita, 2023 (section 125 Cr.P.C.) whereby point of jurisdiction has been decided against the applicant. 3. Learned counsel for the applicant fairly admits that the question of jurisdiction to entertain an application under section 144 of Bhartiya Nagarik Suraksha Sanhita, 2023 (section 125 Cr.P.C.) is mixed question of fact and law. The order has been passed without taking any evidence. He further submits that applicant has also an opportunity to contest this case by filing a written statement. 4. After some argument, learned counsel for the applicant does not want to press this application. 5. In view of the above, the present application is accordingly dismissed as not pressed.
