PUBLIC PROSECUTOR The Court made the following: ORDER: The instant Criminal Petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed, by the Petitioner/Accused No.2, seeking to quash the Order dated 20.11.2024 in Crl.M.P.No.3370 of 2024 in Crime No.505 of 2023 on the file of the Court of II Additional Chief Judicial Magistrate-cum-Mahila Magistrate, Vijayawada and to issue NOC to the Petitioner to get passport. 2. Heard Sri V.S.M.Kuladeep Thoka, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor. 2 3. Learned counsel for the Petitioner / Accused No.2 would submit that the Petitioner has been facing allegations in Crime No.505 of 2023 of Krishnalanka Police Station, Vijayawada for the offences under Sections 354 and 509 read with 34 IPC and the investigation has not been completed. Learned counsel would further submit that, the Petitioner intends to go abroad to attend the convocation of her son, which is going to be held in May, 2026. It is submitted that the Petitioner filed Crl.M.P.No.3370 of 2024 before the trial Court of issuance of No Objection Certificate enabling the Petitioner to get passport and the said petition was dismissed by the trial Court stating that, if the Petitioner goes abroad during pendency of the case, it would be difficult to secure her presence during the trial. 4. Learned Assistant Public Prosecutor would submit that, investigation in the present crime has been completed and charge sheet has also been filed and the same is pending consideration before the trial Court. It is further submitted that, Court may p[ass appropriate orders by imposing suitable conditions. 5. Considering the submissions made, since the Petitioner intends to visit USA to attend the convocation of her son, who is studying M.S in USA, simply because a crime is registered against her, the same is not a hurdle for obtaining passport. For getting passport, No Objection Certificate is required from the concerned Court, since the Petitioner is facing allegations in Crime No.505 of 2023 of Krishnalanka Police Station, Vijayawada registered for the offences under Sections 354 and 509 read with 34 IPC. 3 6. In that view, the Criminal Petition is allowed setting aside the Order dated 20.11.2024 in Crl.M.P.No.3370 of 2024 in Crime No.505 of 2023 on the file of the Court of II Additional Chief Judicial Magistrate-cum-Mahila Magistrate, Vijayawada. Petitioner / Accused No.2 is permitted to get her passport after obtaining permission of the concerned Court before leaving India. Learned Magistrate may impose suitable conditions, when such an application is filed by the Petitioner.
