RAMINENI SUDHEER 2 The Court made the following: ORDER: The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed, by the Petitioner, seeking to modify the conditions imposed in the Order dated 19.12.2024 in CrI.M.P.No.1042 of 2024 on the file of the Court of Metropolitan Sessions Judge cum-1 Addl. District Sessions Judge-Special Judge for trial of offences under NDPS Act, Visakhapatnam. Heard Sri Ramineni Sudheer, learned counsel for the Petitioner and Ms. Prasanna Lakshmi, learned Assistant Public Prosecutor representing the Respondent-State. Perused the material on record. Learned counsel for the Petitioner would submit that the Trial Court vide Order dated 19.12.2024 in Crl.M.P.No.1042 of 2024 in Crime No.480 of 2024 of Pendurthy Police Station, wherein, the Trial Court directed to execute a bond for Rs.5,00,000/- with one surety for like sum to the satisfaction of VII Additional Judicial Magistrate of First Class, Visakhapatnam and shall furnish bank guarantee for Rs.5,00,000/-. Further, the present criminal petition is filed seeking to modify the order and to release the subject vehicle. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. Considering the submissions made and taking into consideration of the facts and circumstances of the case, it is apposite to modify the Order dated 19.12.2024 in Crl.M.P.No.1042 of 2024 on the file of the Metropolitan 3 Sessions Judge-cum- I Additional District & Sessions Judge-Special Judge for trial of offences under NDPS Act, Visakhapatnam for interim custody of the subject vehicle with the following conditions - (a) on his producing the original R.C. and executing a self bond for the value of the subject vehicle to be assessed by the Motor Vehicle Inspector, with two sureties for the like sum each, to the satisfaction of the jurisdictional Magistrate concerned; (b) on his executing an undertaking that he would not alienate the said vehicle or transfer its ownership or change any physical features of the vehicle; and (c) on his executing an undertaking that he would produce the vehicle as and when directed by the trial Court till the case is disposed of, in the trial Court.
