Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order, writ or direction more particularly in the nature of Writ of Mandamus under Article 226 of the Constitution of India questioning the action of the Respondent No. 4 and 5 not conducting investigation in fair, proper and effective manner in Cr.No.97/2025 on the file of Kondepi Police Station, Prakasam District by considering the petitioners Representations dated 10.08.2025/16.08.2025 and 15.09.2025 with regard to alteration of section 302 IPC (103 of BNS) in Cr.No.97/2025 on the file of Kondepi Police Station, Prakasam District as illegal, arbitrary and violative of Article 14, 21 of the Constitution of India and consequently direct the respondents 2 to 5 to complete the investigation in a fair and proper manner by taking into
consideration of petitioner's representation dated 10.08.2025,16.08.2025 and 15.09.2025 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 2 to 5 to complete the investigation in a fair and proper manner by taking into consideration of petitioner’s representation dated 10.08.202516.08.2025 and 15.09.2025 and altering section 302 of IPC (103 of BNS) in Cr.No.97/2025 on the file of Kondepi Police Station, Prakasam District in accordance with the law and pass Counsel for the Petitioner:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“....pleased to issue an order writ or direction more particularly in the nature of Writ of Mandamus under Article 226 of the Constitution of India questioning the action of the Respondent No 4 and 5 not conducting investigation in fair proper and effective manner in Cr No 97/2025 on the file of Kondepi Police Station Prakasam District by considering the petitioners Representations dated 10 08 2025/16 08 2025 and 15.09.2025 with regard to alteration of section 302 IPC 103 of BNS in Cr.No.97/2025 on the file of Kondepi Police Station Prakasam District as illegal, arbitrary and violative of Article 14, 21 of the Constitution of India and consequently direct the respondents 2 to 5 to complete the investigation in a fair and proper manner by taking into consideration of petitioners representation dated 10.08.2025, 16.08.2025 and 15.09.2025 and pass”
2. Heard Sri Vijaya Raju, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner would submit that petitioner herein is the mother of the deceased. Police have registered the case basing on the information given by the husband of the deceased. Petitioner herein has submitted representation to the Police by mentioning the reasons for the death of her daughter and there is no response from the Police.
4. Learned Assistant Government Pleader for Home would submit that investigation is pending in this matter. R.F.S.L report and postmortem report are awaited. Learned Assistant Government Pleader for Home further submits that Court may pass appropriate orders.
5. Considering the submissions made, the Writ Petition is disposed of. The respondent Police are directed to look into the representation of the petitioner and act according to law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
