THE HONOURABLE SMT JUSTICE V.SUJATHA WRIT PETITION NO: 31976/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the Proceedings Rc.DT(LR) 1197/2-25 dated 29.10.2025 issued by the 3rd respondent in suspending the Fair Price Shop Authorization of the petitioner in Shop No.1318005, Thadakanapalli Village, Kallur Mandal, Kurnool District as illegal, improper, unjust arbitrary, colorable exercise of power, without considering the written explanation, without following the procedure and contrary to Andhra Pradesh State Targeted Public Distribution System (Control) order, 2018 and further direct the respondents to permit the petitioner to distribute the essential commodities to the card holders …”

Heard learned counsel for the petitioner, the learned Assistant Government Pleader for Civil Supplies appearing for respondent Nos.1 to 4 and the learned counsel appearing for the respondent No.5. 3. The present writ petition is filed challenging the proceedings Rc.DT(LR) 1197/2-25, dated 29.10.2025, issued by the 3rd respondent suspending the petitioner’s fair price shop authorization for shop No.1318005 situated at Thadakanapalli Village, Kallur Mandal, Kurnool District, on the ground that the said proceedings were issued without considering the explanation submitted by the petitioner on 26.10.2025. 4 VS,J W.P.No.31976 of 2025

However, the learned counsel for the petitioner has also stated that questioning the impugned orders passed by the 3rd respondent dated 29.10.2025, the petitioner has already preferred an appeal before the 2nd respondent along with stay application on 03.11.2025, and as on today, no orders have been passed in the said stay petition filed along with the appeal, and as such, the petitioner is constrained to file the present writ petition. 5. In view of the fact that the petitioner has already preferred an appeal before the 2nd respondent on 03.11.2025, there shall be a direction to the 2nd respondent to consider and pass appropriate orders on the appeal preferred by the petitioner as expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of copy of this order. 6. With the above direction, the Writ Petition is disposed of. No costs.
