removing the public open toilets situated at Jonnagiri Village, Tuggali Mandal, Kurnool District as illegal, arbitrary, violative article 14, 21 of the Constitution of India and contrary to the Swacha Bharath Scheme i.e., ODF and consequently direct the respondents to remove the above said public toilets forthwith and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the 4th respondent to initiate appropriate steps for removal of public toilets situated at Jonnagiri Village, Tuggali Mandal, Kurnool District, as per notice Rc.no.1047/PA3/2023 dt.04.09.2023 issued by the 3rd respondent pending disposal of the main writ petition, and pass Counsel for the Petitioner:

The grievance of the petitioner is that the respondent authorities are not removing the public open toilets situated at Jonnagiri Village,tuggali Mandal, Kurnool District. 2. Heard Sri Narasimhulu Parise, learned counsel for petitioner, Sri M.Sudheer, learned Standing Counsel for Gram Panchayat, Ms.Naga Chandrika, learned Assistant Government Pleader for Panchayat Raj and Sri Venkata Satyanarayana, learned Assistant Government Pleader for Revenue. 3. Sri M.Sudheer, learned Standing Counsel, by placing on record the written instructions of Panchayat Secretary, Jonnagiri Grama Panchayat, Tuggali Mandal, Kurnool District, submitted that the Gram Panchayat would take appropriate steps in removing the open public toilets with the aid of Revenue and Police departments and sought two (02) months time. 4. As the authorities intend to take steps within two (02) months for removal of public toilets, this writ petition can be disposed of. 5.
Accordingly, the writ petition is disposed of, directing the panchayat authorities to take steps for removal of public toilets as expeditiously as possible, at any rate not later than two (02) months from the date of receipt of copy of this order.
