Order 17/10/2025 The present bail applications have been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity
[2025:RJ-JP:42712] (3 of 4) [CRLMB-12011/2025]
“the BNSS”). The petitioners have been arrested in connection with FIR No.0733 dated 27.08.2025 registered at Police Station Mansarovar, District Jaipur City (South) for the offences under Sections 316(2), 111(2)(b), 318(4) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 (for short “the BNS”) and Sections 66C and 66D of the Information Technology (Amended) Act, 2008. Learned counsels for the petitioners submit that they have falsely been implicated in this case. They further submit that the petitioners are in custody for last more than one and a half month, investigation as against them is complete, barring the offence under Section 111(2) of the BNS, rest offences are triable by Magistrate, they have no criminal antecedents and pray for their release on bail. Per contra, learned Public Prosecutor assisted by Sh. Gur Bhupendra Singh, SHO Muhana opposes the prayer. However, Sh. Gur Bhupendra Singh submits that the petitioners have no criminal antecedents and investigation as against them is complete. Heard. Considered. Taking into consideration the contentions advanced by learned counsels for the respective parties, the nature of accusation against them, their length of custody, completion of investigation and absence of criminal antecedents; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioners on bail. Accordingly, the bail applications are allowed and it is
directed that accused-petitioners 1. Chandraprakash Purbiya
