BEFORE HONOURABLE MR. JUSTICE NELSON SAILO ORDER Date : 10.03.2025 Heard Ms. D. Tamuk, learned counsel for the petitioner and Ms. R. Basar, learned Government Advocate for the State respondents. 2. By filing this writ petition, the petitioner has sought for setting aside and quashing the Memorandum dated 02.08.2023, issued by the Superintendent of Police, West Kameng District, Bomdila, by which, a departmental proceedings was initiated against him. 3. In the alternative, the petitioner has also prayed for a direction to complete the departmental proceedings in terms of the guidelines laid down by the Hon’ble Apex Court in the case of Prem Nath Bali Vs. Registrar, High Court of Delhi & Anr., reported in (2015) 16 SCC 415. 4. During the pendency of this writ petition, the Court has been informed that the departmental proceedings against the petitioner has been concluded, but however, the matter is still pending for final decision. Page No.# 3/3 made before the Court on 27.02.2025. Today, Ms. R. Basar, learned Government Advocate submits that it is only within the matter of time that the final decision will be taken by the competent authorities, since the departmental enquiry against the petitioner has already been concluded. 5.
Considering the submissions made and upon hearing the learned counsels for the parties, the writ petition is disposed of with a direction that the respondent authorities concerned to bring the departmental proceedings to its logical conclusion, as expeditiously as possible in accordance with law, within the outer limit of 2(two) months from the date of receipt of a certified copy of this order.
