The State of Jharkhand. 2. Mr. Zeeshan Qamer, son of not known, Deputy Commissioner, Godda, P.O. & P.S.- Godda, Dist.- Godda. .... .... …. Opp. Parties ------ CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR ------ For the Petitioners : Mr. P.K. Choudhary, Advocate For the State : Ms. Rishi Bharati, AC to AAG-III ------ Order No.27 Date: 06-11-2025 1. The present contempt petition has been filed for initiation of contempt proceeding as against the Opposite Party No. 2 alleging willful violation of order dated 19.03.2024 passed by this Court in W.P.(S) No. 4692 of 2022. 2. A show cause affidavit dated 11.08.2025 has been filed on behalf of the Opposite Party No. 2, paragraph nos.9 to 11 of which read as under: ”9. That it is further stated and submitted that by Letter No.1403 dt. 02.08.2025, the annual increment and MACP benefit has been paid to Mr. Vijay Kumar Thakur from the due date. A copy of letter no.1403 dated 02.08.2025 has been annexed as Annexure B to the said show cause affidavit. 10. That it is further stated and submitted that by Letter No. 1013 dt. 02.08.2025, the annual increment and MACP benefit has been paid to Mr. Sitaram Baidh from the due date. A copy of letter no.1013 dated 02.08.2025 has been annexed as Annexure C to the said show cause affidavit. 2025:JHHC:33215 2 Cont. Case (Civil) No.925 of 2024 11. That it is further stated and submitted that by Letter No. 1202 dt. 02.08.2025, the annual increment and MACP benefit has been paid to Mr. Vijay Kant Jha from the due date. A copy of letter no.1202 dated 02.08.2025 has been annexed as Annexure D to the said show cause affidavit.” 3. It is thus submitted that the aforesaid order of this Court has been complied. 4. As against this, learned counsel for the petitioners submits that the amount paid to the petitioner Sitaram Baidh is quite less in comparison to the other petitioners, though all are the appointees of the same date. 5. Be that as it may. Since the benefit of increment as well as MACP has already been extended to the petitioners, I see no reason to further proceed in the present matter. 6. The contempt proceeding as against the opposite party no. 2 is hereby dropped. 7. The present contempt case is accordingly disposed of. 8. The petitioner no.1 Sitaram Baidh is, however, at liberty to take appropriate recourse as permissible under law for redressal of his subsisting grievance. 9. I.A. No. 10830 of 2025 also stands disposed of. (Rajesh Shankar, J.) November 06, 2025 RKM/
