JUSTICE RAJESH SEKHRI, JUDGE ORDER 30.07.2025 Petitioner is aggrieved of order dated 07.01.2025, passed by learned Chief Judicial Magistrate, Samba [“the trial Court”] in a petition titled “Anju Bala and Ors. v. Davinder Singh” filed by respondents under Section 144 of BNSS, primarily on the ground that learned trial Court has taken cognizance under wrong provision i.e., under Section 12 of Protection of Women from Domestic Violence Act, 2005. Learned counsel for the petitioner has submitted that he has filed objections in the aforesaid petition and has taken this plea. Having regard to the limited nature of controversy, the present petition is disposed of with a direction to trial Court to consider the pleas raised by the petitioner and proceed as per law.
