JUSTICE M.NAGAPRASANNA ORAL ORDER Learned counsel appearing for the petitioner files a memo seeking withdrawal of the petition. The memo so filed reads as follows: “1. The petitioner filed the above case challenging the order passed by the Principle Civil Judge and JMFC in Nanjanagud in Ex. No: 32/23. The respondent filed O.S. No: 278/2020 for the recovery of money against the petitioner which was decreed vide Judgment and Decree dated 30/09/2022 against the petitioner which was challenged in R.A. No: 41/2023 before the Senior Civil Judge, Nanjanagud. 2. This Hon'ble Court vide order dated 09/05/2024 was pleased to grant interim order staying the further proceedings of the said court pending disposal of the above case subject to the petitioner depositing a sum of Rs.50,000/- in pursuance of the said order, the petitioner deposited Rs. 50,000/- by way of Demand Draft No: 146215 dated 12/06/2024 in State Bank of India. 3. That during the pendency of the above writ petition, the Hon'ble Senior Civil Judge, Nanjangud vide Order dated 01/07/2025 in R.A. No: 41/2023 was pleased to set aside the Judgment and Decree passed by the learned Trial Court and remanded the matter to the Trial Court for fresh consideration. Therefore in view of the said order the present petition becomes in- fructous. Wherefore, the petitioner most humbly prays that this Hon'ble Court be pleased to permit the petitioner to withdraw the above case and direct the Registry to release the amount of Rs. 50,000/- deposited by him - 4 - HC-KAR NC: 2025:KHC:32730 WP No. 12978 of 2024 before this Hon'ble Court to the petitioner forthwith in the interest of equity and justice.” In terms of memo, the petition is disposed as withdrawn.
