For Non-Applicant/State : Mr. Malay Jain, Panel Lawyer. Hon'ble Shri Ramesh Sinha, Chief Justice Order On Board 03.09.2025 1. This is the Second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 240/2024, registered at Police Station Jamul, District – Durg (C.G.) for the offence punishable under Sections 307, 34 and 201 of IPC and Sections 25 and 27 of the Arms Act. 2. As per the prosecution story in brief, is that on 25.06.2024, near Ghasidas Nagar Maidan, the complainant, Babu Soni, was standing with his friends Ranjeet Yadav, Krishna Choudhary, and Mukesh Yadav. At RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 that time, the co-accused arrived holding a knife and while verbally abusing the victim mother and sister over a prior dispute, attacked Mukesh Yadav with the knife, causing injuries to him. The allegation against the present applicant is that he has also assaulted the Victim with cutter which was alleged to be seized from the applicant. Based on the aforesaid, an FIR was registered against the applicant. Hence, this application. 3. First bail application of the applicant was rejected by this Court vide order dated 11.08.2025 passed in MCRC No. 6317 of 2025. 4. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that there were 3 accused persons including the applicant, but during the course of investigation, the complainant/injured has not deposed anything against the applicant, whereas, he has deposed against the 2 other accused persons. The applicant is in jail since 27.06.2024, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 5. On the other hand, learned State counsel opposes the bail application and submits that from the perusal of the case-diary it transpires that a total of 3 accused persons are involved in the present case including the applicant, and the name of the applicant is mentioned in the FIR, and he has said to have assaulted the injured with a knife, due to which the injured has sustained injuries which are grievous in nature and dangerous to life. As such, the bail application deserves to be rejected. 6. I have heard learned counsel for the parties and perused the case diary. 3 7. Taking into consideration the facts and circumstances of the case and also considering the fact that the charge-sheet has been filed in the present case, and from the perusal of the case-diary it transpires that a total of 3 accused persons are involved in the present case including the applicant, and the name of the applicant is mentioned in the FIR, and he has said to have assaulted the injured with a knife, due to which the injured has sustained injuries which are grievous in nature and dangerous to life, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, this Second bail application of applicant – N. Johnsohn involved in Crime No. 240/2024, registered at Police Station Jamul, District – Durg (C.G.) for the offence punishable under Sections 307, 34 and 201 of IPC and Sections 25 and 27 of the Arms Act, is rejected at this stage. 9.
