By way of this petition, petitioner sought following relief(s) : “10.1) This Hon'ble Court may kindly be pleased to issue appropriate writ and quash/set-aside the impugned order dated 29/5/25 (Annexure P-2) along with the entire proceedings initiated by the court of Tehsildar (Nazul), Kondagaon in the interest of justice. 10.2) This Hon'ble Court may kindly be pleased to call for the entire records of the instant case, for kind perusal of this Hon'ble Court and in case the petitioners shop and houses is demolished, then appropriate compensation shall be paid to the petitioners. 10.3) This Hon'ble Court may also be pleased to grant the cost of the petition to the petitioners. 10.4) Any other relief which this Hon’ble Court deem fit and proper pay also kindly be granted to the petitioners in the interest of justice.” 2. Learned counsel for the State contended that the alternate remedy available to the petitioner under Section 44 of the Chhattisgarh 3 Land Revenue Code, 1959, therefore, this petition is not maintainable. 3. In view of the above, learned counsel for the petitioner seeks permission to withdraw the instant writ petition with liberty to file appropriate application/representation/appeal before the competent authority within 10 days from today. 4. In vies of the above, this petition is dismissed as withdrawn with the aforesaid liberty and after 10 days, the concerned revenue authority shall proceed further action in accordance with rules, regulations and law. 5.
