Neutral Citation No. - 2025:AHC:55533 Court No. - 35 Case :- WRIT - C No. - 11089 of 2025 Petitioner :- Shishu Pal Singh Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Ashok Kumar Singh,Ram Mangal Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar Nigam,J.
1. Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
2. The instant writ petition has been filed for the following relief:
"A writ of certiorari to quash order dated 05.03.2025 passed in revision No. 1225 of 2024, Computer Case No. C202411000001225 (Shishu Pal Singh Vs. Smt. Sushila Devi and others), and order dated 10.04.2024 passed in Case No. 5228 of 2021 Computer Case No. T202111170105228 (Smt. Sushila Devi Vs. Shishu Pal and others) proceeding under section 35(2) of U.P. Revenue. Code 2006."
3. Contention of the learned counsel for the petitioner is that the mutation proceedings initiated by the respondents, were stayed on account of order passed by this Court in Writ Petition No. 36245 of 2011. In the aforesaid writ petition, interim order granted for maintaining status quo as on date with regard to nature and possession in the land in dispute. Against the order passed by Tahsildar, staying the proceeding, an appeal was filed and the order was set-aside and the matter was remanded. Against the said order, the petitioner preferred a revision and the same was also been dismissed.
4. In view of the above, I am of the considered opinion that no error has been committed by the lower appellate court in setting aside the order passed by the Tahsildar.
5. Writ petition lacks merit and is accordingly, dismissed. Order Date :- 16.4.2025 Ved Prakash (Manish Kumar Nigam,J.) Digitally signed by :- VED PRAKASH SHARMA High Court of Judicature at Allahabad
