The said vehicle was seized as early as on 10.05.2017. It is discernible from the records that the same is challenged by the petitioner before this Court only in the year 2021 as evidenced by Ext.P3. Now the impugned order was passed on 01.08.2024, which according to the petitioner, was served upon him when the same was produced in Contempt of Case No.1857/2025 as per Annexure R1(e). As far as Ext.P7 order is concerned, it is appealable under Sec.27of Kerala Conservation of Paddy Land and Wetland Act, 2008. Since the challenge raised in the writ petition involves the disputed questions of facts, it is only proper that petitioner invokes his statutory remedy. In such circumstances, this writ petition is closed, without prejudice to the right of the petitioner to challenge Ext.P7 order by invoking his Appellate remedy under Sec.21 of the Kerala Conservation of Paddy Land and Wetland Act.
