Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application u/s 528 BNSS has been filed against the order dated 31.01.2025, passed by the learned Additional Principal Judge, Family Court-I, Aligarh in Case No.486 of 2024 (Smt. Priyanka v. Rajesh) under Section 128 CrPC, P.S.- Akrabad, District- Aligarh arising out of Criminal Misc. Case No.1062 of 2022 (Smt. Priyanka v. Rajesh) under Section 125 CrPC, P.S.- Akrabad, District- Aligarh. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and that the applicant may be permitted to pay/deposit the arrears of maintenance in reasonable installments and a direction may be made to the Family Court concerned for the same. 4. In view of the aforesaid, it is directed that in case the applicant moves an application before Family Court concerned within a period of three weeks from today to pay/deposit the arrears of maintenance in installments, the same shall be considered and decided by the Family Court concerned expeditiously, in accordance with law. 5.
