PUBLIC PROSECUTOR The Court made the following order: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Crime No.174 of 2024 of Kothakota Police Station, Anakapalli district. 2 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 09.12.2024, at about 09.00 am, on credible information, the Sub-Inspector of Police, Kothakota Police Station, along with his staff and mediators, proceeded to Gatreddi’s threshing floor, on the road of Kalyanapulova Village to Dondapudi Forest Check Post, Ravikamatham Mandal and, while conducting vehicle checking, found A1 to A3 in possession and illegal transportation of 110 Kgs of Ganja in a Maruti Swift LXI car bearing registration No.KA 19 MJ 5816. They confessed about the involvement of A4 in the present crime. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 110 Kgs of Ganja, which is a commercial quantity. It is 3 submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and other accused are to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3 at this stage. 6.
