JUSTICE V.SRISHANANDA) Heard Sri.Anuj A. Agranayak, learned counsel appearing on behalf of Sri.Abhishek L. Kalled, learned counsel for the petitioner and Smt.Girija S. Hiremath, learned High Court Government Pleader for the respondent/State. 2. Petitioner is the accused in Crime No.129/2024 dated 10.11.2024 of Bhatkal Town Police. From the custody of present accused and three more accused persons, police were able to seize 9 kg 170 grams of ganja near Tengingundi Cross on National Highway-66 on 10.11.2024 at about 5.30 p.m. Charge sheet is filed. 3. Taking note of the fact that seized ganja is intermediary quantity; continuation of the present petitioner in the custody is no longer warranted as the - 3 - NC: 2025:KHC-D:5945 CRL.P No. 101245 of 2025 objection of the prosecution would not depict that petitioner is a habitual offender. 4. Other apprehensions of the prosecution can be met with by imposing suitable conditions. 5. Accordingly, the following: ORDER i. Petition is allowed. ii. Petitioner is directed to be enlarged on bail on executing a bond in a sum of Rs.1,00,000/- [Rupees one lakhs only] with two sureties for the likesum to the satisfaction of the Trial Court. iii. Petitioner shall not directly or indirectly tamper the prosecution witnesses in any manner. iv. Petitioner shall attend the court regularly. - 4 - NC: 2025:KHC-D:5945 CRL.P No. 101245 of 2025 v. Petitioner shall not leave the jurisdiction of Uttara Kannada – Karwar District without prior permission. vi. Petitioner shall not indulge in similar offences.
