JUSTICE SANDEEP KUMAR ORAL ORDER 10 17-01-2025 Heard learned counsel for the parties. 2. Heard learned counsel for the petitioners and learned APP for the State. 3. The petitioners have preferred this application for grant of anticipatory bail in connection with Shahpur P.S. Case No. 787 of 2023 registered for the offence punishable under section 302/34 of the Indian Penal Code and under Section 27 of Patna High Court CR. MISC. No.33194 of 2024(10) dt.17-01-2025 3/4 the Arms Act. 4. The deceased was accused in the killing of the father of one Vinay Kumar Singh, which had taken place long back. The deceased after getting bail, left the area and came to Danapur and made a house and was staying there. Vinay Kumar Singh after getting the knowledge about the address of the deceased, contacted criminals and engaged them to kill the deceased. The criminals called the deceased and killed him and thereafter they came with their motorcycles and changed their motorcycles. They parked their motorcycles at the door of the petitioners and fled away on two scooties. 5. Learned senior counsel for the petitioners submits that the petitioners are not involved in the killing of the deceased and they are not party to the conspiracy. The investigation against these petitioners are still pending. 6. Learned APP for the State has submitted that though the petitioners have participated in the investigation on the orders of this Court but to find out exact details of the case the custodial interrogation of the petitioners are necessary. 7. I have considered the submissions of the parties. Though, Mr. Shahi, learned senior counsel submits that no material has come during investigation till now since the Patna High Court CR. MISC. No.33194 of 2024(10) dt.17-01-2025 4/4 investigation is still pending and the conspiracy angle is being investigated by the police, the petitioners do not deserve anticipatory bail. 8. Accordingly, the application for anticipatory bail of the petitioners are hereby rejected. They are directed to surrender and pray for regular bail within four weeks so that the proper investigation is done by the police. Re:- Cr. Miscellaneous No. 51820 of 2024 9.
