JUSTICE MOHAMMAD NAWAZ ORAL ORDER Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 2. This petition is preferred under Section 483 of BNSS, 2023, by accused Nos.3 and 5, to enlarge them on bail in Crime No.242/2025 of Chikkamagaluru Rural Police Station, Chikkamagaluru, registered for an offence punishable under Section 310(2) of BNS, 2023. - 3 - HC-KAR NC: 2025:KHC:38311 CRL.P No. 12319 of 2025 3. In the complaint lodged by Harish S/o Sadashiva, he has alleged that on 12.07.2025 at about 8.00 p.m., while he along with his friend, Umar was proceeding on a TVS Apache motorcycle bearing registration No.KA-18-EH-1386 from Indavara Paradise Bar towards Indavara, 6-7 unknown persons came in an Accent car bearing registration No.KA-04-MA-9959 and intentionally hit their vehicle against their motorcycle and made them to fall. They assaulted them with hands and car key causing bleeding injuries, snatched a Oppo mobile phone worth Rs.30,000/-, a gold chain weighing about 19 grams, cash of Rs.30,000/- and the bike key. 4. FIR is registered against 6-7 unknown persons. It is to be noted that the identity particulars of the accused are not mentioned in the complaint. Accused Nos.3 to 6 were arrested on 13.07.2025. Petitioners are arraigned as accused Nos.3 and 5 in the remand application. A Oppo mobile phone and a car bearing registration No.KA-04-MA- 9959 are seized. However, there is no recovery of cash or - 4 - HC-KAR NC: 2025:KHC:38311 CRL.P No. 12319 of 2025 gold chain from them. Petitioners are already interrogated and not required for further interrogation. No criminal antecedents against the petitioners are brought to the notice of the Court. They have undertaken to furnish adequate surety, to ensure their regular presence before the Court. Hence, the following: ORDER i. Petition is allowed. ii. Petitioners/accused Nos.3 and 5 in Crime No.242/2025 of Chikkmagaluru Rural Police Station, Chickmagalur, shall be enlarged on bail subject to following conditions: 1. They shall execute a bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. They shall furnish proof of their residential address and shall inform the Court, if there is change in the address. - 5 - HC-KAR NC: 2025:KHC:38311 CRL.P No. 12319 of 2025 3. They shall not directly or indirectly tamper with the prosecution witnesses. 4. They shall not indulge in committing any offence. 5. They shall appear before the trial Court on every date of hearing without fail. Violation of any of the above condition shall result in cancellation of bail.
